Welcome to onyxdtf.com (the “Site”), operated by ONYX DTF, a division of ONYX INK, LLC (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of our Site, services, and products, including any file uploads and account features.

By visiting our Site, creating an account, uploading files, or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

Legal Statement: ONYX DTF is a division of ONYX INK, LLC. All billing and order processing are handled under the same legal entity.

1) Eligibility & Account Responsibility

You must be able to form a legally binding contract to use this Site. If you create an account, you agree to:

  • Provide accurate and complete information

  • Maintain the confidentiality of your login credentials

  • Accept responsibility for all activity under your account

We may suspend or terminate accounts for fraud, abuse, unauthorized access attempts, or violations of these Terms.

2) Orders & Order Acceptance

All orders are subject to acceptance and availability. We may refuse, cancel, or limit orders at our discretion, including when:

  • The order appears fraudulent or unauthorized

  • The file(s) submitted are inaccessible, corrupted, or violate our policies

  • There is an error in product information, inventory, or system functionality

  • The order violates intellectual property or legal restrictions

Once an order is placed, it may not be possible to change or cancel it if it has entered production or processing.

3) Custom Products & Print-Ready Responsibility

Our products are custom-produced based on the artwork, selections, and specifications you submit.

You are responsible for:

  • Ensuring your artwork is print-ready

  • Verifying design details, spelling, sizing, placement, and background transparency

  • Confirming you have the legal rights to use and reproduce your submitted files

We are not responsible for quality issues caused by:

  • Low-resolution files, pixelation, compression artifacts

  • Incorrect sizing selections or scaling requests

  • Unintended backgrounds, borders, or artwork errors

  • Improper pressing or garment handling

4) File Uploads, Ownership & Intellectual Property

By uploading any file, you represent and warrant that:

  • You own the content or have all necessary rights, licenses, and permissions

  • The content does not infringe any third-party intellectual property rights

  • The content does not violate applicable laws or regulations

You retain ownership of your uploaded files. You grant us a limited license to use, process, store, and reproduce the files only as needed to fulfill your order, provide support, enable reorders, and operate our services.

We do not claim ownership of your artwork.

5) Prohibited Content & Use

You agree not to use the Site or services to submit, request, or produce content that is:

  • Illegal, fraudulent, or deceptive

  • Infringing, defamatory, or threatening

  • Hateful or discriminatory

  • Sexually explicit involving minors (strictly prohibited)

  • Designed to promote violence or criminal activity

  • Malicious or intended to disrupt systems, including viruses or harmful code

We may refuse any order or remove access if content violates these Terms or applicable law.

6) Production Standards & Variations

Because printing is a production process, minor variations may occur. You acknowledge that:

  • Color appearance can vary between screens and real-world output

  • Minor tolerances may occur due to file format, compression, or material characteristics

  • Application results depend on pressing equipment, temperature consistency, pressure, and garment type

We aim for consistent, professional results, but we do not guarantee exact screen-to-print color matching across all devices and conditions.

7) Shipping, Delivery & Risk of Loss

Shipping timelines and delivery handling are controlled by the carrier once an order is in transit. Risk of loss transfers to you when the package is handed to the carrier, unless otherwise required by law.

If a package is delayed, misrouted, or marked delivered but not received, you agree to cooperate with carrier claims and verification steps.

8) Returns, Refunds & Replacements

Because items are custom-produced, returns are generally not accepted. If there is a verified production error on our side, we may offer a replacement or store credit at our discretion.

Your rights and eligibility are governed by our Return & Refund Policy, which is incorporated into these Terms by reference.

9) Pricing Errors & Site Accuracy

We work to keep product information accurate, but errors may occur. If a pricing or product detail error is identified, we may cancel affected orders and issue appropriate corrections or refunds where required.

10) Promotions & Coupon Use

Promotions, coupon codes, and discounts may be limited by:

  • Expiration dates

  • Product eligibility

  • Account status

  • One-time use restrictions

We reserve the right to modify or cancel promotions at any time, consistent with applicable law.

11) Third-Party Services Used for Operations

We may rely on third-party providers for payment processing, shipping tools, file storage, analytics, and platform functionality. Your use of the Site may be subject to those providers’ technical requirements. We are not responsible for outages or interruptions caused by third-party systems beyond our control.

12) Disclaimer of Warranties

The Site and services are provided on an “as is” and “as available” basis. To the maximum extent allowed by law:

  • We do not guarantee uninterrupted or error-free operation of the Site

  • We do not warrant that the Site will meet all user expectations at all times

13) Limitation of Liability

To the maximum extent permitted by law, ONYX INK, LLC and its divisions (including ONYX DTF) will not be liable for:

  • Indirect, incidental, special, or consequential damages

  • Loss of profits, revenue, goodwill, or business opportunities

  • Damages arising from file issues, incorrect artwork, or application errors

  • Carrier delays, shipping interruptions, or delivery issues beyond our control

Our total liability for any claim related to a purchase will not exceed the amount paid for the applicable order, unless otherwise required by law.

14) Indemnification

You agree to indemnify and hold harmless ONYX INK, LLC, its divisions, employees, and affiliates from claims, liabilities, damages, and expenses arising from:

  • Your uploaded content or artwork rights violations

  • Your misuse of the Site

  • Your breach of these Terms

15) Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any disputes will be handled in an appropriate court located in Florida, unless otherwise required by law.

16) Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised effective date. Continued use of the Site after changes means you accept the updated Terms.
